Common use of Development Projects Clause in Contracts

Development Projects. The Company has no reason to believe that (i) the estimated production capacity for each of the time periods set forth in Section 3.01(w) of the Company Disclosure Letter with respect to the four development projects described in the Company's Annual Report on Form 10- K for the fiscal year ended December 31, 1995 will not be reached during such time periods, or (ii) the estimated costs set forth in Section 3.01(w) of the Company Disclosure Letter with respect to each such development project will be exceeded.

Development Projects. The Company has no reason to believe that (i) the estimated production capacity for each of the time periods set forth in Section 3.01(w) of the Company Disclosure Letter with respect to the four development projects described in the Company's Annual Report on Form 10- 10-K for the fiscal year ended December 31, 1995 will not be reached during such time periods, or (ii) the estimated costs set forth in Section 3.01(w) of the Company Disclosure Letter with respect to each such development project will be exceeded.

The Company has no reason to believe believe, subject to the receipt of necessary permits and approvals which the Company reasonably expects as of the date of this Agreement, that (i) the estimated production capacity for each of the time periods set forth in Section 3.01(w3.1(x) of the Company Disclosure Letter with respect to the four development projects described in the Company's Annual Report on Form 10- K for the fiscal year ended December 31, 1995 therein will not be reached during such time periods, or (ii) the estimated costs set forth in Section 3.01(w3.1(x) of the Company Disclosure Letter with respect to each such development project will be materially exceeded.
