Common use of Discharge of Duties Clause in Contracts

Discharge of Duties. The Master Custodial Administration Agreement Administrator shall discharge its duties set forth in this Agreement solely in the interests of the Participant of the Participating Plan and their beneficiaries and for the exclusive purpose of providing benefits to Participant of the Participating Plan and their beneficiaries and defraying reasonable expenses of administering the Custodial Account. The Master Custodial Administration Agreement Administrator shall discharge its duties hereunder with the care, skill, prudence and diligence under the circumstances then prevailing that a prudent person acting in like capacity and familiar with such matters would use in the conduct of an enterprise of a like character and with like aims.
