Disciplinary Action and Appeal. (A) Disciplinary action against an employee for substance abuse shall occur only after an administrative investigation in which the employee is informed of the evidence against him/her, and has had an opportunity to respond. (B) Employees who are found to be abusing drug(s) which have been legally prescribed are subject to all provisions of this article. (C) Employees may appeal any formal disciplinary action according to the current Contract between the Board and the Union at the time of the disciplinary action.
