Disclosure for Management and Administration. Business Associate may disclose PHI received by Business Associate in its capacity as a Business Associate of CCIU for the proper management and administration of Business Associate if (i) the disclosure is required by law or (ii) Business Associate (a) obtains reasonable assurances from the person to whom the PHI is disclosed that it will be held confidentially and used or further disclosed only as required by law or for the purpose for which it was disclosed to the person and (b) the person notifies the Business Associate of any instances of which it becomes aware in which the confidentiality of the PHI has been breached.
Disclosure for Management and Administration. Business Associate may disclose PHI and/or ePHI created or received in its capacity as a Business Associate of Covered Entity for the proper management and administration of Business Associate if (i) the disclosure is Required by Law or (ii) Business Associate (a) obtains reasonable assurances from the person to whom the PHI and/or ePHI is disclosed that it will be held confidentially and used or further disclosed only as Required by Law, or for the purpose for which it was disclosed to the person and (b) the person agrees to notify Business Associate of any instances in which it becomes aware the confidentiality and security of the PHI and/or ePHI has been Breached.
Disclosure for Management and Administration. Except as otherwise limited in this BAA, Business Associate may, consistent with 45 C.F.R. 164.504(e)(4), disclose PHI for the proper management and administration of Business Associate, provided (i) the disclosure is Required by Law, or (ii) Business Associate obtains reasonable assurances from the person to whom the PHI is disclosed (“Person”) that it will be held confidentially and will be used or further disclosed only as Required by Law or for the purpose for which it was disclosed to the Person, and that the Person agrees to immediately notify Business Associate in writing of any instances of which it becomes aware in which the confidentiality of the information has been breached or is suspected to have been breached.
Disclosure for Management and Administration. Except as otherwise limited in this Agreement, BA may disclose PHI for the proper management and administration of the BA or to carry out the legal responsibilities of the BA, provided that:
a. Disclosures are required by law; or
b. BA obtains reasonable assurances from the person to whom the information is disclosed that it will remain confidential and will be used or further disclosed only as required by law or for the purpose for which it was disclosed to the person, and
c. The person notifies the BA of any instances of which it is aware in which the confidentiality of the information has been breached.
Disclosure for Management and Administration. Business Associate may disclose Covered Entity’s PHI for the proper management and administration of Business Associate if:
1. the disclosure is required by law, or
2. Business Associate obtains from such third party a written agreement:
(i) that Covered Entity’s PHI will be held confidentially and in compliance with HIPAA, and used or further disclosed only as required by law or for the purpose for which it was disclosed to such third party; and
(ii) to notify Business Associate, without unreasonable delay, of any instances of which such third party becomes aware of a Breach that compromises the confidentiality of Covered Entity’s PHI.

Associate in its capacity as a Business Associate of CE for the proper management and administration of Associate if (i) the disclosure is required by law or (ii) Associate (a) obtains reasonable assurances from the person to whom the PHI is disclosed that it will be held confidentially and used or further disclosed only as required by law or for the purpose for which it was disclosed to the person and (b) the person notifies Associate of any instances of which it becomes aware in which the confidentiality of the PHI has been breached.] [Optional; 45 CFR

Business Associate may disclose to a third party PHI received by the Business Associate in the capacity as a Business Associate for the proper management and administration of the Business Associate if: (A) the disclosure is Required by Law; and, (B) provided that Business Associate complies with federal and state laws governing the Covered Entity including Pennsylvania laws governing Mental Health Services and Substance Abuse Services; (C) reasonable assurances are obtained from the third party to whom the Protected Health Information is disclosed that the Protected Health Information will be held confidential as provided pursuant to this Agreement and not used or further disclosed, except as Required by Law or for the purpose for which it was disclosed to the third party; and (D) an agreement from such person to immediately notify Business Associate of any instances of which the third party is aware in which the confidentiality of the Protected Health Information has been breached.
