Common use of Discontinued Facilities Clause in Contracts

Discontinued Facilities. Notwithstanding any other provision of the Agreement, but subject to and without limiting Section 4.4, below, this Amendment, or any Verizon tariff (subject to any tariff provisions expressly incorporated by reference into the Agreement), but subject to the transition requirements associated with the TRRO, as set forth in Sections 3.4, 3.5, and 3.7 below, Verizon may, effective as of July 14, 2005 and without further notice to RNK, cease offering or providing access on an unbundled basis at rates prescribed under Section 251 of the Act to any facility that is a Discontinued Facility, whether as a stand-alone UNE, as part of a Combination, or otherwise.

Discontinued Facilities. Notwithstanding any other provision of the Agreement, but subject to and without limiting Section 4.4, below, this Amendment, or any Verizon tariff (subject to any tariff provisions expressly incorporated by reference into the Agreement), but subject to the transition requirements associated with the TRRO, as set forth in Sections 3.4, 3.5, and 3.7 below, Verizon may, effective as of July 14, 2005 and without further notice to RNKTWCIS (MA), cease offering or providing access on an unbundled basis at rates prescribed under Section 251 of the Act to any facility that is a Discontinued Facility, whether as a stand-alone UNE, as part of a Combination, or otherwise.

Discontinued Facilities.
