Discretion Retained. The Parties agree that MPWMD’s partial reimbursement contributions for Company Environmental and Permitting Costs for the Desalination Plant pursuant to this Agreement may, in the sole and absolute discretion of MPWMD, be reimbursed, in the future, from proceeds of the permanent financing for the CCRWP.
