Common use of Dispute Resolution by Arbitration Clause in Contracts

Dispute Resolution by Arbitration. Apart from any controversy or claim pertaining to HHMI’s rights under Article 10 or otherwise under this Agreement, any dispute between the parties regarding any payments made or due under this Agreement will be settled by arbitration in accordance with the Licensing Agreement Arbitration Rules of the American Arbitration Association. The parties are not obligated to settle any other dispute that may arise under this Agreement by arbitration.

Apart from any controversy or claim pertaining to HHMI’s rights under Article 10 or otherwise under this Agreement, any Any dispute between the parties regarding any payments made or due (including for Nonroyalty Sublicensing Consideration) under this Agreement Agreement, will be settled by arbitration in accordance with the Licensing Agreement JAMS Arbitration Rules of the American Arbitration Associationand Procedures. The parties are not obligated to settle any other dispute that may arise under this Agreement by arbitration. Notwithstanding the foregoing, no dispute affecting the rights or property of HHMI shall be subject to the arbitration provisions set forth in this Article 17.
