Disputes Limitation. 1.6 Nothing in paragraphs 1.4 or 1.5 shall prevent either Party from disputing information contained in or referred to in a Final Confirmation Statement at any time where it is reasonable in all the circumstances to do so, which includes in the case of fraud and manifest error. No dispute shall be raised under this paragraph 1.6 in relation to information in a Confirmation Statement regarding a Trading Period after the first anniversary of the date on which the relevant statement becomes final. Any dispute as to whether it is reasonable to raise a dispute under this paragraph 1.6 shall be referred to the Expert for determination in accordance with paragraph 3 of Schedule 6.

Disputes Limitation. Nothing in clauses 7.3, 7.4, 7.5 or 7.6 shall prevent either party from disputing information contained in or referred to in a Final Confirmation Statement or a Final Annual Confirmation Statement at any time where it is reasonable in all the circumstances to do so, which includes in the case of fraud and manifest error. No dispute shall be raised under this clause 7.7 in relation to information in a Confirmation Statement or a Final Annual Confirmation Statement regarding a Settlement Period after the first anniversary of the date on which the relevant statement becomes final. Any dispute as to whether it is reasonable to raise a dispute under this clause 7.7 shall be referred to the Expert for determination in accordance with clause 15.2.
Disputes Limitation. Nothing in this Section 18 shall prevent either Party from disputing the information contained in or referred to in a Confirmation Statement or Meter Reconciliation Statement at any time where it is reasonable under all the circumstances so to do, provided that no dispute shall be raised in relation to information regarding a Settlement Period after the first anniversary of the day during which such Settlement Period occurred.

  • Review Process Limitations The Asset Representations Reviewer will have no obligation (i) to determine whether a Delinquency Trigger Event has occurred or whether the required percentage of Noteholders has voted to direct an Asset Representations Review under the Indenture, (ii) to determine which Receivables are subject to an Asset Representations Review, (iii) to obtain or confirm the validity of the Review Materials, (iv) to obtain missing or insufficient Review Materials except as specifically described herein, (v) to take any action or cause any other party to take any action under any of the Transaction Documents to enforce any remedies for breaches of representations or warranties about the Eligible Representations, (vi) to determine the reason for the delinquency of any Review Receivable, the creditworthiness of any Obligor, the overall quality of any Review Receivable or the compliance by the Servicer with its covenants with respect to the servicing of such Review Receivable, or (vii) to establish cause, materiality or recourse for any failed Test as described in Section 3.03.
