Common use of Distant/ Away Work Clause in Contracts

Distant/ Away Work. Where an employee volunteers to be transferred to a distant site, they shall not be entitled to living away allowances or travel expenses. Where an employee is specifically requested to transfer to a distant site, they shall be entitled to the following living away allowances; 28.1 The Company may require an Employee to undertake distant work at locations where it is not reasonable or possible for the Employee to return to his or her normal place of residence each night. 28.2 Where this occurs the Company shall provide the Employee with accommodation in a hotel, motel or rented premises at no expense to the Employee. This accommodation shall be in clean and well maintained premises, and be of an adequate standard, in a single or twin room with good furnishings, bedding, floor coverings, lighting, heating / cooling and access to bathroom facilities. 28.3 The Company shall also reimburse an employee undertaking distant work a sum of $60 (not taxed) per day for: • The cost of three adequate meals each day; and • For other incidental expenses incurred by the employee while undertaking distant duty. • If the employer provides meals as well as accommodation, employees shall not be eligible for this payment. 28.4 These allowances will not apply to Employees who reside in the local region where the Employee is locally engaged on the Company’s project but maintains a separate place of residence from that recorded on the Employees job application form. 28.5 Employees shall not be entitled to receive the daily fares allowance on those days that an Employee is receiving the living away from home allowance. All arrangements regarding distant sites shall be formalised in writing and witnessed by another employee. The selection of employees for away work shall be solely at the discretion of ▇▇▇▇▇ & Gray Electrical Pty Ltd.

Distant/ Away Work. Where a. The provisions of clause 7 of the Parent Award will apply to Distant Work as defined in the Award except for the following: 1. The following allowances will be substituted for the allowance prescribed under subclause 7.1.1 of the Award: i) where the Company arranges and pays for accommodation- an employee Employee will be paid an allowance of $70.00 per day will apply for each day that the Employee is required to live away from home; and ii) where an Employee is required to arrange and/or pay for his/her accommodation, an Employee will be paid an additional $35.00 per day. 2. If an Employee incurs costs in excess of the allowances paid in accordance with subclause a in respect of any period of Distant Work, (s)he shall be reimbursed for any additional costs reasonably and necessarily incurred, provided that the Company may require the Employee to justify and provide evidence of the expenditure claimed. 3. If an Employee volunteers to be transferred to a distant site, they (s)he shall not be entitled to the living away allowances or travel expensesallowances otherwise payable under clauses 7 and 4 respectively of the Parent Award. 4.
