If the Contractor should neglect to prosecute the Work properly or fail to perform any provisions of this Contract, the District, after FORTY- EIGHT (48) hours’ written notice to the Contractor, may make good such deficiencies, without prejudice to any other remedy it may have, including but not limited to the District hiring its own forces or another contractor to replace the Contractor’s nonconforming Work, in which case the District shall either issue a deductive Change Order, a Construction Change Directive, or invoice the Contractor for the cost of that work.
