Common use of Documentation 389 Clause in Contracts

Documentation 389. Without prejudice to the relevant provisions of the Group Management Agreement, Wwhere the Managers are providing Technical Management in 390 accordance with sub-clause 3.2 and/or Crew Management in 391 accordance with sub-clause 3.1, they shall make available, 392 upon Owners’ request, all documentation and records related 393 to the Safety Management System (SMS) and/or the Crew 394 which the Owners need in order to demonstrate compliance 395 with the ISM Code, the ISPS Code and STCW 95 or to defend a 396 claim against a third party. 397
