Common use of DOUBLE JOINTING Clause in Contracts

DOUBLE JOINTING. In order to preserve work customarily performed by Employees working under this Agreement, it is agreed that as a primary working condition, all double jointing and re-beveling of pipe shall be performed by an Employer bound to this Agreement, except as otherwise mutually agreed upon in writing by the Union and the Contractor Association with relation to any particular job or project. It is further agreed that no subterfuge shall be used to avoid the intent and scope of this provision, and this Agreement shall apply to all firms, corporations or Contractors owned, financed or in any way controlled by an Employer bound to this Agreement. A violation of this provision shall be considered a material breach of the Agreement and shall be grounds for the Union’s or Contractor’s immediate cancellation of the Agreement with the Individual Employer or Union which has violated this provision. The Union’s and/or Contractor’s right to terminate the Agreement under this provision shall not be exclusive and shall not impair any and all remedies which the Union and/or Contractor might otherwise seek for a breach of this provision.
