Common use of Double Occupancy Clause in Contracts

Double Occupancy. If two (2) of you occupy the Residence and if one (1) of you leaves the campus or dies, this Agreement shall not terminate with respect to the remaining Resident. If the remaining Resident elects to keep this Agreement in effect, the Entrance Fee shall be deemed to apply to the remaining Resident and the Second Person Entry Fee shall be refunded. The remaining Resident shall pay the Monthly Service Fee for single occupancy. Any refund or repayment due shall be paid only upon termination of this Agreement as to the remaining Resident and shall be computed based upon the remaining Entrance Fee.
