Double Recovery and Double Counting. The Purchaser shall not be entitled to recover from the Seller under this Agreement or otherwise more than once in respect of the same Losses suffered or amount for which the Purchaser is otherwise entitled to claim (or part of any such Losses or amount) and no amount (or part of any amount) shall be taken into account, set off or credited more than once under this Agreement or otherwise, with the intent that there will be no double counting.
Double Recovery and Double Counting. 18.1 No Party (taken together with their respective Affiliates, where relevant) shall be permitted to recover damages or obtain any payment, reimbursement, remedy restitution or indemnity more than once in respect of the same loss or set of circumstances that give rise to more than one Claim or right under this Agreement or any Transaction Document.
