Common use of Downward Re-evaluation Clause in Contracts

Downward Re-evaluation. If a position is re-evaluated downward, the incumbent in the position: a) whose pay rate exceeds the maximum of the lower pay level, shall be red-circled and shall not be entitled to any general increases until such time as the maximum rate exceeds the employee’s pay rate; b) whose pay rate is equal to or less than the maximum of the lower pay level, shall be placed in the lower pay level and be entitled to salary progression and general increases.
