Duty to Support Sample Clauses

Duty to Support. Subject to the reservations in Sections 1.6, 6.2, and 6.3.4, each Party shall support the Interim Measures set forth in Appendices C and D, and will not advocate additional or alternative measures for the protection of environmental resources affected by the Project during the Interim Period.

Duty to Support. A. Shipper’s Duty to Support Prior to Commencement Date. To the extent not inconsistent with Applicable Law, Shipper hereby agrees prior to the Commencement Date: (a) to reasonably support and cooperate — and not to oppose, obstruct or otherwise interfere in any manner, direct or indirect — with the efforts of Monarch to obtain all governmental, regulatory and other authorizations and approvals necessary for the construction and operation of the Pipeline in the form and manner proposed by Monarch; ; and (b) to not take, directly or indirectly, any action that (i) is designed to delay review or approval of any petitions or applications to any Governmental Authorities related to the Pipeline, or (ii) would materially and adversely affect the Pipeline or this Agreement. Notwithstanding the foregoing, nothing herein shall prevent Shipper from (i) protesting any regulatory or other filings that are in conflict with the terms of this Agreement, and (ii) proceeding in any manner consistent with Applicable Law if this Agreement is terminated or if the Pipeline has been abandoned by Monarch.
Duty to Support. In connection with the initial construction and operational start-up of the Pipeline, Shipper hereby agrees (a) to take all such actions and do all such things as UNEV shall reasonably request at UNEV’s expense in connection with its applications for, and the processing of, necessary certificates, approvals and authorizations of FERC and other Governmental Authorities, and (b) not to take any action that is designed to or may delay review or approval of the applications to FERC or any other Governmental Authorities or indicate a lack of support for the Pipeline. Shipper shall not challenge any tariff filing during the Term.
Duty to Support. Shipper hereby agrees (a) to take all such actions and do all such things as CCPS shall reasonably request in connection with its applications for, and the processing of, necessary certificates, approvals and authorizations of FERC and other Governmental Authorities, and (b) not to take any action that is designed to or may delay review or approval of the applications to FERC or any other Governmental Authorities or indicate a lack of support for the Spearhead Pipeline.
Duty to Support. Shipper shall not directly or indirectly protest, complain, or take any action that is designed to or may delay review or approval of the Joint Tariff, including the Incentive Rates (and the Indexed Rates, unless the foregoing are in conflict with the terms of this Agreement; provided, that nothing in the foregoing shall restrict Shipper from protesting any future changes to the the Joint Tariff that is not consistent with this Agreement.
