Early Delivery of Possession. Tenant may continue to occupy the Premises and Improvements until the Condemnor takes physical possession. At any time following Notice of Intended Condemnation, Tenant may in its sole discretion, with the consent of each Leasehold Mortgagee and the Limited Partner, to the extent required, elect to relinquish possession of the Premises to County before the actual Taking. The election shall be made by notice declaring the election and agreeing to pay all Rent required under this Lease to the Date of Taking. Tenant’s right to apportionment of or compensation from the Award shall then accrue as of the date that the Tenant relinquishes possession.

However, at any time following notice of intended total taking, or within the time limit specified for delivering possession in the provision on substantial taking, LESSEE may elect to deliver possession of the premises to COUNTY before the actual taking. The election shall be made by notice declaring the election and covenanting to pay all rents required under this lease to the date of taking, LESSEE's right to apportionment of or compensation from the award shall then accrue as of the date that LESSEE goes out of possession.
Early Delivery of Possession. Landlord expects that Landlord will have the Tenant Finish Improvements completed and the Premises ready for occupancy on or before the Commencement Date. If the Premises are ready for occupancy prior to the Commencement Date, Landlord shall deliver possession of the Premises to Tenant at such time, and Tenant may then occupy the Premises subject to all of the terms, conditions and covenants of this Lease other than the Term and the obligation to pay rent as provided in Paragraphs 2 and 3 hereof. In such event, Tenant shall not be obligated to pay Base Rent or the Rent Adjustment for the period between such date and the Commencement Date.

Landlord expects that it will substantially complete (as such term is defined in the Work Letter) the Tenant Finish Improvements and have the Premises ready for occupancy on or before the Commencement Date, If the Premises are ready for occupancy prior to the Commencement Date. Landlord may, at Tenant's request, deliver possession of the Premises to Tenant at such time, and Tenant may then occupy the Premises as a tenant from month-to-month, subject to all of the terms, conditions and covenants of this Lease other than the Term and the obligation to pay rent as provided in Paragraphs 2 and 4 hereof, respectively. In such event, Tenant shall not be obligated to pay Base Rent or the Rent Adjustment for the period between such date and the Commencement Date.
