Early Termination by Provider. Up until the time the system begins producing electricity, the developer may terminate the PPA for any reason. • If it terminates the PPA then, it must remove any of its equipment and restore the landfill to its original condition.
Early Termination by Provider. ‌ Provider may terminate this Agreement as to any System and its related Site and Property in the event that any of the following events or circumstances occur prior to the Commercial Operation Date, in which case neither Provider nor Customer will have any liability for such termination, except that no such termination shall act to relieve Provider from any obligation hereunder regarding the removal of such System and the restoration of such Site:
