Common use of Effect of Entries Clause in Contracts

Effect of Entries. The entries made in the records maintained pursuant to paragraph (b) of this Section shall be PRIMA FACIE evidence of the existence and amounts of the obligations recorded therein; PROVIDED that the failure of the Lender to maintain such records or any error therein shall not in any manner affect the obligation of the Customer to repay the Loans in accordance with the terms of this Agreement.

Effect of Entries. The entries made in the records maintained pursuant to paragraph (bd) or (e) of this Section shall be PRIMA FACIE evidence of the existence and amounts of the obligations recorded therein; PROVIDED that the failure of any Lender or the Lender Administrative Agent to maintain such records or any error therein shall not in any manner affect the obligation of the Customer Borrowers to repay the Loans in accordance with the terms of this Agreement.

The entries made in the respective records maintained pursuant to paragraph (ba) of this Section shall be PRIMA FACIE prima facie evidence of the existence and amounts of the obligations recorded therein; PROVIDED provided that the failure of the any Lender to maintain such records or any error therein shall not in any manner affect the obligation of the Customer Borrower to repay the Loans in accordance with the terms of this Agreement.

The entries made in the records maintained pursuant to paragraph (bd) or (e) of this Section shall be PRIMA FACIE evidence of the existence and amounts of the obligations recorded therein; PROVIDED that the failure of any Lender or the Lender Administrative Agent to maintain such records or any error therein shall not in any manner affect the obligation of the Customer Account Parties to repay the Loans in accordance with the terms of this Agreement.
