Effect of Seventh Amendment. Except as expressly amended herein, the terms of the Comprehensive Agreement shall remain in full force and effect. From and after the date hereof, the “Comprehensive Agreement” shall be deemed to mean the Comprehensive Agreement, as modified by this Seventh Amendment.

This Seventh Amendment shall not be deemed, either expressly or impliedly, to waive, amend or supplement any provision of the Agreement other than as set forth herein. For the avoidance of doubt, this Seventh Amendment (including the subject matter herein) may not be amended, modified or changed in any way except by written instrument executed by an authorized representative of each Party.

Effect of Seventh Amendment. Except as expressly modified by this Seventh Amendment, the Rights Agreement remains in full force and effect and is hereby ratified and confirmed.

Effect of Seventh Amendment. Upon the occurrence of the Seventh Amendment Date, any basket which permits a certain amount of a given type of transaction over the life of this Agreement (however denominated), without being deemed to prohibit any transaction occurring prior to the Seventh Amendment Date, shall be reset such that such basket provision shall cover the time period from the Seventh Amendment Date through the term of this Agreement or the time period otherwise specified herein. Effect of Seventh Amendment. The amendment set forth herein is limited as written, is effective only in the specific instance and for the specific purpose for which given, and shall not be deemed to be a waiver of or consent to, or modification of in any respect, any other term or condition in the A&R Loan Agreement or any of the documents referred to herein or therein. The terms and provisions set forth in each Loan Document are hereby ratified and confirmed by each Borrower in all respects. Effect of Seventh Amendment. Except as modified herein, the terms and conditions of the Lease shall remain unmodified and continue in full force and effect. In the event of any conflict between the terms and conditions of the Lease and this Seventh Amendment, the terms and conditions of this Seventh Amendment shall prevail.
