Common use of Effective Date, Commencement of Work and Completion Dates Clause in Contracts

Effective Date, Commencement of Work and Completion Dates. This Agreement is effective upon approval by all parties and the Department, which is evidenced by the date signed by the Department on page one, Standard Agreement, STD 213 (the “Effective Date"). The Recipient agrees that neither the construction of the Development nor the Work has commenced as of the deadline for submittal of applications set forth in the Notice of Funding Availability. The Recipient agrees that the Work shall be completed as specified in this Agreement, and as set forth in the Project Report, incorporated in this Agreement by reference subject to the Agreement expiration date specified on page 1, number 2, of this Agreement (STD 213), and in Exhibit B, unless a written request for an extension is submitted and written approval by the Department is provided within 90 days prior to the expiration date of the Agreement. Any extension to the expiration date shall require an amendment to this Agreement.

The Recipient agrees that neither the construction of the Development nor the Work Capital Improvement Project has not commenced as of the deadline for submittal of applications set forth in the Notice of Funding Availability. The Recipient agrees that the Work shall be completed as specified in this Agreement, and as set forth in the Project Report, incorporated in this Agreement by reference subject to the Agreement expiration termination date specified on page 1one, number 2two, of this Agreement (STD 213)Agreement, and in subject to the expiration date provided by Exhibit BB paragraph 4.B if a different date is specified therein, unless a written request for an extension is submitted and written approval by the Department is provided within 90 ninety (90) days prior to the termination or expiration date of the this Agreement. Any extension to the termination or expiration date shall require an amendment to this Agreement.

The Recipient Sponsor agrees that neither the construction of the Affordable Housing Development nor the Work has not commenced as of the deadline for submittal of applications set forth in the Notice of Funding Availability. The Recipient Sponsor agrees that the Work shall be completed as specified in this Agreement, Agreement and as set forth in the Final and Corrected Project Report (Project Report), incorporated in this Agreement by reference herein as Exhibit A-1, subject to the Agreement expiration date specified on page 1, number 2, of this Agreement (STD 213), and in Exhibit Bparagraph 3 below, unless a written request for an extension is submitted and written approval by the Department is provided within 90 days prior to the expiration date of the Agreement. Any extension to the expiration date shall require an amendment to this Agreement.
