Common use of Effectiveness of Service Clause in Contracts

Effectiveness of Service. Notice shall be deemed to be effective as follows: (a) in the case of personal delivery or registered mail, on delivery; (b) in the case of electronic mail, eight (8) hours following confirmed transmission and when sent after five (5) p.m. notice is deemed to have been given at eight (8) a.m. the following Business Day; and (c) in the case of facsimiles, [two (2) hours] following confirmed transmission and where sent after five (5) p.m. notice is deemed to have been given at eight (8) a.m. the following Business Day.
