Common use of Eligibility of submission Clause in Contracts

Eligibility of submission. If, at any stage of the review process, the Service determines that a VCP submission is seriously deficient or that the application of VCP would be inappropriate or impracticable, the Service reserves the right to return the submission without contacting the Plan Sponsor. If no substantive processing of the case has occurred, the Service will refund the compliance fee submitted with the request.
