Eligible Checks and Items. You agree to scan and transmit only checks as that term is defined in Federal Reserve Regulation CC ("Reg CC"). You agree that the image of the check transmitted to us shall be deemed an "item" within the meaning of Articles 3 and 4 of the applicable Uniform Commercial Code. You agree that you will not use Mobile Deposit Capture to scan and deposit any checks or other items as shown below: • Checks or items payable to any person or entity other than you, or to you and another party. • Checks or items containing alteration to any of the fields on the front of the check or item (including the MICR line), or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. • Checks or items previously converted to a substitute check, as defined in Reg CC. • Checks or items drawn on a financial institution located outside the United States. • Checks or items that are remotely created checks, as defined in Reg CC. • Checks or items not payable in United States currency. • Checks or items dated more than 6 months prior to the date of deposit. • Checks or items that are postdated, defined as having an issue date after the date of deposit. • Checks or items on which a stop payment order has been issued or for which there are insufficient funds. • Checks or items previously presented for payment to us or another financial institution. • Checks or items marked, in any manner, as “non-negotiable.” • Third party checks, defined as any item that is made payable to another party and subsequently endorsed to you by such party or any successor payee. • Checks or items prohibited by our current procedures relating to Mobile Deposit Capture or which are otherwise not acceptable under the terms of your Account. Nothing in this Agreement shall be construed as requiring us to accept any check or item for deposit, even if we have accepted that type of check or item previously. Nor shall we be required to identify or reject any checks or items that you may scan and deposit that fail to meet these requirements.

You agree authorize us to process any image that the you send us or convert any image of the check transmitted to us an Image Replacement Document for subsequent presentment and collection; it shall thereafter be deemed an "item" within the meaning of Articles 3 and 4 of the applicable Uniform Commercial Code. You agree that you will not use Mobile Deposit Capture to scan and deposit any of the following types of checks or other items as shown belowwhich shall be considered ineligible items: • Checks or items payable to any person or entity other than you, the person or to you and another partyentity that owns the account that the check is being deposited into (commonly called two party checks). • Checks or items containing an alteration to any of the fields on the front of the check or item (including the MICR line)item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. • Checks or items payable jointly, unless deposited into an account in the name of all payees. • Checks previously converted to a substitute check, as defined in Reg Reg. CC. • Checks or items drawn on a financial institution located outside the United States. • Checks or items that are remotely created checks, as defined in Reg CC. • Checks or items not payable in United States currency. • Checks or items dated more than 6 months prior to the date of deposit. • Checks or items prohibited by GCU’s current procedures relating to the Services or which are otherwise not acceptable under the terms of your GCU account. • Checks payable on sight or payable through drafts, as defined in Reg. CC. • Checks with any endorsement on the back other than that are postdated, defined as having an issue date after specified in this agreement. • Checks that have previously been submitted through the date of depositService or through a mobile deposit capture service offered at any other financial institution. • Checks that have previously been deposited at by other methods at GCU or any other financial institution. • Checks or items on which a stop payment order has been issued or for which there are insufficient funds. • Checks or items previously presented for payment to us or another financial institutionInsurance drafts. • Credit card cash advance checks. • Money Orders. • Checks or items marked, in any manner, as “non-negotiable.” • Third party checks, defined as any item that is made payable to another party and subsequently endorsed to you by such party or any successor payee. • Checks or items prohibited by our current procedures relating to Mobile Deposit Capture or which are otherwise not acceptable under the terms of your Account. Nothing in this Agreement shall be construed as requiring us to accept any check or item for deposit, even if we have accepted that type of check or item previously.
