Eligible Items. You agree to scan and deposit only "checks" as that term is defined in Federal Reserve Regulation CC ("Reg. CC"). When the image of the check transmitted to the Bank is converted to an Image Replacement Document for subsequent presentment and collection, it shall thereafter be deemed an "item" within the meaning of Articles 3 and 4 of the Uniform Commercial Code.

Eligible Items. You agree to scan and deposit only checks, as that term is defined in Federal Reserve Regulation CC (“Reg. CC”). You agree that the image of the check transmitted to us shall be deemed an “item” within the meaning of Article 4 of the Uniform Commercial Code as adopted in Tennessee. You agree that you will not use RDC to scan and deposit any of the following checks or other items: (1) Checks or items payable to any person or entity other than you, including a check payable to “Cash”. (2) Checks or items containing obvious alteration to any of the fields on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. (3) Checks or items previously converted to a substitute check, as defined in Reg. CC. (4) Checks or items drawn on a foreign bank or payable in a foreign currency. (5) Checks or items that are demand drafts or remotely created checks (checks lacking the original signature of the drawer). (6) Checks that have been previously returned stop payment or account closed. (7) Checks or items dated more than six months prior to the date of deposit.

Checks payable jointly, unless deposited into an account in the name of all payees. 4. Checks previously converted to a substitute check, as defined in Reg. CC. 5. Checks drawn on a financial institution located outside the United States. 6. Checks that are remotely created checks, as defined in Reg. CC. 7. Checks not payable in United States currency. 8. Check previously deposited by other means. 9. Checks that are payable to cash. 10. Checks on which the numerical and written amounts are different. 11. Checks dated more than 6 months prior to the date of deposit or postdated (dated for a future date). 12. Checks or items prohibited by the Bank’s current procedures relating to the Mobile Deposit Service or which are otherwise not acceptable under the terms of your Account Agreement. 13. Checks payable on sight or payable through Drafts, as defined in Reg. CC. 14. Checks with any endorsement on the back other than that specified in this agreement. 15. Checks that have previously been submitted through the Mobile Deposit Service or through a remote deposit capture service offered at any other financial institution.

Checks or items containing obvious alteration to any of the fields on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. d. Checks or items previously converted to a substitute check, as defined in Reg CC. e. Checks or items drawn on a financial institution located outside the United States. f. Checks or items that are remotely created checks, as defined in Reg CC. g. Checks or items not payable in United States currency. h. Checks or items dated more than 6 months prior to the date of deposit. i. Checks or items prohibited by Sanger Bank current procedures relating to the Services or which are otherwise not acceptable under the terms of your Sanger Bank account.

Any of the following types of checks or other items shall be considered ineligible items and may be rejected by us: • Checks payable to any person or entity other than the person or entity that owns the account that the check is being deposited into. • Checks containing an alteration on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check is drawn. • Checks payable jointly, unless deposited into an account in the name of all payees. • Checks previously converted to a substitute check, as defined in Reg. CC. • Checks not payable in United States currency. • Checks dated more than 6 months prior to the date of deposit. • Checks or items prohibited by mobile deposit (including, by not limited to, savings bonds) or which are otherwise not acceptable under the terms of your Bank account. • Checks or items prohibited or which are otherwise not acceptable under the terms of your Bank account. • Checks payable on sight or payable through Drafts. • Checks with any endorsement on the back other than that specified in this agreement. • Checks that have been previously deposited through any channel (including, but not limited to, any financial institution branch or ATM), or that have been submitted through the Service or through any remote deposit capture service (including mobile deposit) offered at this or any other financial institution. • Digitally scanned, photocopied or otherwise duplicated versions of checks. Processing Schedule. Deposited items received by us before 5:00 PM (ET) will be processed that Banking Day. Deposited items received by us after 5:00 PM (ET) will be processed the next Banking Day. Applicable Rules. You agree to comply with all rules and operating guidelines of the Electronic Check Clearing House Organization, the Check 21 Act, Federal Reserve Regulation CC, and similar state laws and regulations, as applicable.

Checks drawn on a foreign bank and/or that are not payable in United States currency; g. Checks that are payable on sight or payable through drafts, as defined in Reg. CC, or are remotely created checks, as defined in Reg. CC; h. Checks that are undated, post-dated, or are dated more than 6 months prior to the date of deposit; i. Checks with any endorsement on the back other than that specified in this Agreement; j. Checks that have previously been deposited by any remote capture or physical delivery; k. Checks or items that are drawn or otherwise issued by the U.S. Treasury Department; l. Checks that have previously been returned unpaid for any reason; m. Travelers Checks; n. Checks payable to “Cash”; o. Checks transmitted from outside the United States; p. Registered government warrants; q. Money Orders; or r. Checks that are prohibited by our current procedures relating to the mobile remote deposit capture feature, or which are otherwise not acceptable under your Deposit Account Agreement, or as we may otherwise determine in our sole discretion; s. Government checks of any type, state or federal. We may in our sole discretion, and without liability to you, refuse any check for any or no reason, or elect to take the check on a collection basis only. We reserve the right to charge back to your account, at any time, any item that we subsequently determine was an ineligible item. We are not liable for any loss, costs, or fees you may incur as a result of our chargeback of an ineligible item

You agree that the image of the check transmitted to MidFirst shall be deemed an "item" within the meaning of Article 4 of the Uniform Commercial Code as adopted in Oklahoma. You agree that you will not use MidFirst Mobile Deposit to scan and deposit any checks or other items shown below: i. Checks or items payable to any person or entity other than you, including a check made payable to you and one or more persons or entities not named as an account holder on your depository Account. ii. Checks or items containing obvious alteration to any of the fields on the front of the check or item, or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. iii. Checks or items that are not endorsed on the back of the check as specified in this Agreement. iv. Checks or items previously converted to a substitute checks, as defined in Reg CC. v. Checks or items drawn on a financial institution located outside the United States. vi. Checks or items that are remotely created checks, as defined in Reg CC. vii. Checks or items dated more than three (3) months prior to the date of deposit. viii. Checks or items that have previously been submitted through the MidFirst Mobile Deposit or through a remote deposit capture service offered at any other financial institution. ix. Checks or items prohibited by MidFirst’s current procedures relating to the MidFirst Mobile Deposit or which are otherwise not acceptable under the terms of your MidFirst account.

Eligible Items. You may only use the Service to deposit images of original checks (i.e., drafts drawn on a bank, credit union, or savings and loan that are payable on demand). You may not deposit any of the following without our prior express written consent: (a) checks payable to any person or entity other than you (i.e., payable to another party and then endorsed to you also known as third party checks); (b) checks payable to you and another party who is not a joint owner on your Bank account; (c) checks that contain evidence of alteration, or that you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check is drawn; (d) checks that are irregular in anyway (e.g., where the numerical and written amounts are different); (e) checks previously converted to a substitute check (i.e., paper checks created from an electronic image); (f) checks previously converted to an image replacement document; (g) checks drawn on a financial institution located outside the United States; (h) remotely created checks or demand drafts (i.e., a check that does not bear the signature of the person who owns the account on which the check is drawn); (i) checks that are not payable in U.S. currency or that are sent from a location outside the U.S.; (j) checks that are postdated or are more than six months old; (k) checks that do not comply with the Bank’s procedures relating to the Service, as specified in the “Requirements” section below; (l) checks involving transactions that violate any federal or state law, rule or regulation; (m) checks payable to “Cash;” (n) checks that have previously been returned unpaid for any reason; (o) registered government warrants or payable-through drafts; (p) checks that exceed any limitation described in this Agreement; (q) checks that are otherwise not acceptable under the terms and conditions of your Bank account agreement: or checks payable to Banc of California. Our processing of any of the checks described above will not obligate us to continue that practice, and we may stop doing so without cause or prior notice. You may use the Service to deposit checks to the following eligible Bank deposit accounts:
Eligible Items. You agree: ● to deposit only images that originated as paper checks, and no third-party or electronic checks may be deposited using the Mobile Deposit Service; ● to implement and maintain security measures, including firewall protection, in compliance with your obligations under these End User Terms; ● to keep your email address updated within Aspiration’s online account services; ● to properly endorse all items using the Mobile Deposit Service as stated herein; ● not to deposit items into your account unless you have authority to do so; ● after you submit an item for deposit using the Mobile Deposit Service you will not redeposit, otherwise transfer, or negotiate the original item; ● after you submit an item for deposit you are solely responsible for the storage or destruction of the original item as further provided below; ● the electronic image of the item will become the legal representation of the item for all purposes; ● any image we receive accurately and legibly represents all of the information on the front and back sides of the original item as originally drawn; and ● to promptly provide us with a written notice of any claim you receive regarding the Mobile Deposit Service.
