Common use of Elimination of Health Risk Clause in Contracts

Elimination of Health Risk. 1. Whenever an employee's health is at risk due to possible exposure to a communicable disease, the employer shall take the measures necessary to eliminate the health risk. The Employer's actions shall be in compliance with this article of the Contract. 2. If elimination of the health risk requires the implementation of a temporary or permanent removal of an employee with a chronic communicable disease, the Employer shall comply with the provisions of this Contract and O.R.C. 3319.13. 3. If elimination of the health risk requires an employee to be immunized, all costs of the immunization not covered by the employee's insurance carrier shall be borne by the Employer. The employer shall not be required to pay in excess of $1,000.00 per employee per year.
