Common use of Emergencies and Exempt Operational Periods Clause in Contracts

Emergencies and Exempt Operational Periods. Buyer shall not be obligated to accept electric energy or make payments based on electric energy delivered pursuant to Section 7, Compensation, for any electric energy which the Seller may have available at the Plant during Emergencies or Exempt Operational Periods after Buyer has given Seller timely notice of such Emergencies or Exempt Operational Periods but which Buyer does not accept and receive due to such Emergencies or Exempt Operational Periods.
