Common use of Emergency Defence costs Clause in Contracts

Emergency Defence costs. If it is not possible for the Insured to obtain the Underwriters’ consent prior to incurring Defence Costs in relation to a covered Claim, then the Underwriters will waive their requirement for consent, provided that such consent is sought within fourteen (14) days of the first of such Defence Costs being incurred. This coverage is subject to a Sublimit of Liability of $25,000 NZD unless otherwise specified in Item 5 of the Schedule.
