Emergency Duty. (1) This clause applies if:
(a) an employee is directed to attend for duty to meet an emergency; and
(b) the employee would not ordinarily have been on duty at that time; and
(c) the employee was not given notice of the direction before ceasing ordinary duty; and
(d) the employee is not at a classification above the salary barrier or an AGS fee earner.
(2) However, the Secretary may decide that this clause applies to an employee at a classification above the salary barrier (unless they are an AGS fee earner).
(3) For the time on duty, the employee is to be paid:
(a) at the rate of double time; and
(b) for at least 2 hours.
(4) The time on duty is taken to include time necessarily spent in travelling to and from duty.
(5) This clause does not apply if the employee is subject to a restriction direction.
(6) Clause 3.23 (rest relief after overtime) does not apply to overtime worked in circumstances covered by this clause unless the actual time worked is at least 3 hours for each attendance.
Emergency Duty. 41.1 Where an employee is called on duty to meet an emergency at a time when the employee would not ordinarily have been on duty, and no notice of such call was given to the employee prior to ceasing ordinary duty, the employee will be paid for such emergency duty at the rate of double time.
41.2 The time for which payment will be made under this clause will include time necessarily spent in travelling to and from duty.
41.3 The minimum payment under this clause will be two hours.
41.4 The rate of payment for emergency duty will be 200% of the employee’s ordinary hourly rate of pay.
41.5 This clause does not apply to employees whose duty for the day is varied by alteration of the commencement of the scheduled shift to meet an emergency.
Emergency Duty. Employees called in to work during emergency situations such as for a hurricane, while other employees are entitled to stay home and yet receive their regular pay, will be entitled to four (4) hours of paid time or compensatory time for each day this situation occurs.

Such compensation shall be for a minimum of three (3) hours in the event the employee works less than this amount of time. Emergency Duty. When an employee is called to work at other than the normal scheduled working time, the employee shall receive a minimum of one (1) hour of compensatory time off or pay.

In those emergent situations and in those cases wherein the administrative staff determines that the assignment of a teacher to lunchtime playground supervision duty is required for the safety and welfare of the children, it is understood and agreed that the administrative staff's authority to assign is retained.
