Common use of Employee Discretion Clause in Contracts

Employee Discretion. Except as otherwise specified in this Article, an employee shall be entitled to elect to receive compensatory time off in lieu of cash payment for overtime at any time the employee’s compensatory time bank is fifty (50) hours or less. When an employee works overtime for which the employee may elect to be compensated in cash or compensatory time off: i. If the employee elects cash, they shall be compensated for such overtime at the rate of one and one-half (1½) times the employee's regular hourly rate. ii. If the employee elects compensatory time, one and one-half (1½) hours of compensatory time shall be accrued for each hour of overtime worked.
