Common use of Employer Initiated Referral Clause in Contracts

Employer Initiated Referral. An Employee may be referred to the Employee Assistance Program by the Employer as a result of deteriorating attendance or job performance or inappropriate behaviour while at work, where it is believed that the cause of the problem is of a personal nature. Such referral must be made in the presence of a Union representative. Involvement in the program will not jeopardize an employee’s job security or future promotional opportunities within the Employer's operations as an important aspect of the EAP program is to assist the employee so that job security and future prospects are preserved and enhanced.
