Employer Underpayment. If, within the Claim Settlement Period, the Claim Settlement Total exceeds Employer Payments, Employer will pay the difference to Claim Administrator. The Claim settlement will be determined within ninety (90) days from the last day of the Claim Settlement Period. Claim Administrator will notify Employer in writing of the results of the Claim settlement. Any sums due Claim Administrator will be paid Timely by Employer.

Employer Underpayment. If, within the Claim settlement period, the Claim Settlement Total exceeds the sum of the Projected Claim Funding payments made by the Employer Projected Claim Funding payments, and the Reserves (including any adjustments in Reserves required by Section 6.2 where an increase of the Reserves could result in a reduction of the Claim settlement), Claim Administrator will advance the difference to Employer in accordance with the terms and conditions set forth in Exhibit 5, and Employer agrees to repay any such advance upon demand by Claim Administrator in accordance with the Employer Payment Method. The costs may be reimbursed by Aggregate Stop Loss, if applicable. Except at termination, the Claim settlement will be determined within ninety (90) days from the last day of the Claim settlement period. Claim Administrator will notify Employer in writing of the results of the Claim settlement.

  • Overpayment Provider shall be liable to the GLO for any costs disallowed pursuant to financial and/or compliance audit(s) of funds received under this Contract. Provider shall reimburse such disallowed costs from funds other than those that Provider received under this Contract. Provider must refund disallowed costs and overpayments of funds received under this Contract to the GLO within 30 days after the GLO issues notice of overpayment to Provider.

  • Overpayments Contractor promptly shall refund to Purchaser the full amount of any erroneous payment or overpayment. Such refunds shall occur within thirty (30) calendar days of written notice to Contractor; Provided, however, that Purchaser shall have the right to elect to have either direct payments or written credit memos issued. If Contractor fails to make timely refunds of overpayment(s) (either directly or by credit memo), Contractor shall pay Purchaser interest at the rate of one percent (1%) per month on the amount overdue thirty (30) calendar days after notice to Contractor.
