Common use of Employment and Compensation Clause in Contracts

Employment and Compensation. 1. The Board hereby employs Xxxxx as the Assistant Superintendent for Teaching and Learning for three years, commencing July 1, 2022, and terminating on June 30, 2025, with such responsibilities and duties as set forth in the Assistant Superintendent for Teaching and Learning job description and as may be fixed by the Board in this Agreement and in its policies, rules, and regulations. The Administrator shall provide professional services for 52 weeks (260 days) for each contract year during the term of this Agreement. A “contract year” shall be defined as the period from July 1st of one year through June 30th of the following year. 2. The Board shall pay to the Administrator a salary of One Hundred Sixty-Two Thousand and Ninety dollars, $162,090.00 for her work during the 2022–2023 contract year in equal installments in accordance with the rules of the Board governing payments of administrative staff members in the District. The Administrator’s annual salary for the 2023–2024 contract year, and every contract year thereafter, shall be determined by the Board after the Superintendent’s review of the Administrator’s performance in accordance with paragraph F, provided that any such annual salary shall not be less than the Administrator’s salary for the 2022–2023 contract year. The Administrator hereby accepts employment upon the terms and conditions hereinafter set forth. 3. In addition to the annual salary stated in paragraph A.2 of this Agreement, the Board shall make a contribution on behalf of Xxxxx to the State of Illinois Teachers' Retirement System (“TRS”), in satisfaction of Xxxxx’x entire required retirement contribution to TRS. In addition, the Board shall pay the Administrator’s required contribution to TRS for Teacher Retirees’ Health Insurance (“THIS”). It is the intention of the parties to qualify all such payments paid by the Board on the Administrator’s behalf as employer payments pursuant to Section 414(h) of the Internal Revenue Code of 1986, as amended. The Administrator does not have any right or claim to these amounts except as they may become available at the time of retirement or resignation from TRS. Both parties acknowledge that the Administrator did not have the option of choosing to receive the contributed amounts directly, instead of having such contributions paid by the Board to TRS, and that such contributions are made as a condition of employment to secure the Administrator’s future services, knowledge and experience. 4. Any salary or other modification made during the term of this Agreement shall be in the form of a written amendment and shall become a part of this Agreement, but such modification shall not be construed as a new Agreement with the Administrator, or as an extension of the termination date of this Agreement. 5. During the term of this Agreement, the Administrator shall hold a valid Professional Educator License and Endorsement issued by the State of Illinois Teachers’ Certification Board qualifying her to act as an Administrator for the District. 6. The Administrator acknowledges that by accepting the terms of this multi-year Agreement, the Administrator waives any right to tenure or continued contractual service in the School District for the duration of the multi-year contract or any multi-year contract extension pursuant to Section 5/10-23.8a of the Illinois School Code.

The Administrator shall provide professional services for 52 weeks (260 days) for each contract year during the term of this Agreement. A “contract year” shall be defined as the period from July 1st of one year through June 30th of the following year. 2. The Board shall pay to the Administrator a salary of One Hundred SixtyFifty-Two Thousand and Ninety Four Thousand, Five Hundred dollars, $162,090.00 154,500.00 for her work during the 2022–2023 2021–2022 contract year in equal installments in accordance with the rules of the Board governing payments of administrative staff members in the District. The Administrator’s annual salary for the 2023–2024 2022–2023 contract year, and every contract year thereafter, shall be determined by the Board after the Superintendent’s review of the Administrator’s performance in accordance with paragraph F, provided that any such annual salary shall not be less than the Administrator’s salary for the 2022–2023 2021–2022 contract year. The Board hereby employs Xxxxx as the Assistant Superintendent Administrator for Teaching and Learning for three two (2) years, commencing on July 1, 20222012, and terminating on June 30, 2025, with such responsibilities and duties as set forth in the Assistant Superintendent for Teaching and Learning job description and as may be fixed by the Board in this Agreement and in its policies, rules, and regulations2014. The Administrator salary for the period July 1, 2012 through June 30, 2013 shall provide professional services for 52 weeks be Ninety Nine Thousand Six Hundred Fifty Five Dollars and two cents (260 days$99,655.02) for each contract year during the term of this Agreement. A “2012-2013 contract year” . The salary for the period July 1, 2013 through June 30, 2014 shall be defined as the period from July 1st of one year through June 30th of the following year. 2One hundred One Thousand Six Hundred Forty Eight dollars and Twelve cents. The Board shall pay to the Administrator a ($101,648.12). This salary of One Hundred Sixty-Two Thousand and Ninety dollars, $162,090.00 for her work during the 2022–2023 contract year is payable in 26 equal installments per year in accordance with the rules of the Board governing payments of other administrative staff members in the District. The Administrator’s annual salary for the 2023–2024 contract year, and every contract year thereafter, shall be determined by the Board after the Superintendent’s review of the Administrator’s performance in accordance with paragraph F, provided that any such annual salary shall not be less than the Administrator’s salary for the 2022–2023 contract year. In addition to the annual salary stated in paragraph A.2 A.1 of this Agreementcontract, the Board shall make a contribution pay on behalf of Xxxxx the Administrator to the State of Illinois Teachers' ’ Retirement System (“TRS”)System, in satisfaction 85% of Xxxxx’x entire required retirement contribution contributions to TRS. In addition, the Board shall pay the Administrator’s required contribution to TRS for Teacher Retirees’ Health Insurance (“THIS”). It is the intention of the parties to qualify all such payments paid by the Board on the Administrator’s behalf as employer payments pursuant to Section 414(h) of the Internal Revenue Code of 1986, as amendedsaid pension system. The Administrator does shall not have any right or claim to these amounts said amounts, except as they may become available at the time of retirement or resignation from TRSthe State of Illinois Teachers’ Retirement System. Both parties acknowledge that the Administrator did not have the option of choosing to receive the contributed amounts directly, instead of having such contributions paid by the Board to TRSthe Teachers’ Retirement System, and further acknowledge that such contributions are made as a condition of employment to secure the Administrator’s future services, knowledge and experience. 43. Any salary or other adjustment or modification made during the term of life this Agreement contract shall be in the form of a written amendment and shall become a part of this Agreementcontract, but such adjustment or modification shall not be construed as a new Agreement contract with the Administrator, or nor as an extension of the termination date of this Agreementcontract. 54. During the term of this Agreementcontract, the Administrator shall hold a valid Professional Educator License and Endorsement properly registered certificate issued by the State of Illinois Teachers’ Certification Board qualifying her him to act as an Administrator for in the School District. 5. The Administrator shall submit, at Board expense, to a physical or mental examination by a physician licensed in Illinois to practice medicine and surgery in all its branches whenever the Board deems such examination necessary and in accordance with applicable law. As a condition of employment, the Administrator also agrees to comply with all health requirements established by law. 6. The Administrator acknowledges that that, pursuant to The School Code and by accepting the terms of this a multi-year Agreementcontract, the Administrator he waives any right all rights to tenure or continued contractual service in the School District only for the duration term of the multi-year contract or and any multi-year contract extension pursuant to Section 5/10-23.8a of extensions thereof; however the Illinois School CodeAdministrator shall not lose any previously acquired tenure credit with the District.

The Administrator shall provide professional services for 52 weeks (260 days) for each contract year during the term of this Agreement. A “contract year” shall be defined as the period from July 1st of one year through June 30th of the following year. 2. The Board shall pay to the Administrator a salary of One Hundred Forty-Six Thousand, One Hundred Sixty-Two Thousand and Ninety Five dollars, $162,090.00 146,165.00 for her work during the 2022–2023 2022– 2023 contract year in equal installments in accordance with the rules of the Board governing payments of administrative staff members in the District. The Administrator’s annual salary for the 2023–2024 contract year, and every contract year thereafter, shall be determined by the Board after the Superintendent’s review of the Administrator’s performance in accordance with paragraph F, provided that any such annual salary shall not be less than the Administrator’s salary for the 2022–2023 contract year. The Administrator shall provide professional services for 52 weeks (260 days) for each contract year during the term of this Agreement.
