Common use of Employment of District Residents Clause in Contracts

Employment of District Residents. (a) The Unions and Contractors agree that, to the extent allowed by law, and as long as they possess the requisite skills and qualifications, the Unions will exert their best efforts to refer and/or recruit sufficient numbers of skilled craft “Local Residents” as defined herein, to fulfill the requirements of the Contractors. In recognition of the fact that the District and the communities surrounding Project Work will be impacted by the construction of the Project Work, the parties agree to support the hiring of workers from the residents of these surrounding areas, as well as veterans, regardless of their residence. Towards that end, the Unions shall first, exert their best efforts to encourage and provide referrals and utilization of qualified workers residing in those first tier zip codes, as set forth in Attachment C attached hereto, including veterans, regardless of their residence. If the Unions cannot provide the Employers in the attainment of a sufficient number of Local Residents from within the first tier zip codes, the Unions shall second, exert their best efforts to then recruit and identify for referral Local Residents residing in second tier zip codes which reflect the Gateway Cities, as set forth in Attachment C attached hereto. If the Unions still have not provided the Employers in the attainment of a sufficient number of Local Residents, the Unions shall then third, exert their best efforts to recruit and identify for referral Local Residents residing within Los Angeles County. For dispatch purposes, employees referred from any of the above three (3) tiers shall be considered to be Local Residents. (b) A goal of forty percent (40%) of all of the construction workers employed on the Project shall be from workers described in (a) above with a goal that at least fifteen percent (15%) of all workers on each Project are from those first tier zip codes. To facilitate the dispatch of Local Residents, all Contractors will be required to utilize the Employee Craft Request Form whenever they are requesting the referral of any employee from a Union referral list for any Project Work, a sample of which is attached as Attachment D. When Local Residents are requested by the Contractors, the Unions will refer such workers regardless of their place in the Unions’ hiring halls’ list and normal referral procedures. (c) The Project Labor Coordinator shall work with the Unions and Contractors in the administration of this local residency goal. The Unions shall, upon request of the Project Labor Coordinator, provide their response(s) to the Craft Employee Request Form submitted to them by the Contractors. The Unions will also respond in writing, if requested, if they, or any of them, are unable to fill the dispatch request. As part of this process, and in order to facilitate the contract administration procedures, as well as appropriate benefit fund coverage, all Contractors shall require their "core work force" and any other persons employed other than through the Union referral process, to register with the appropriate hiring hall, if any, prior to their first day of employment at a project site. (d) Notwithstanding the transfer or portability provisions of the Schedule A agreements, Contractors which are directly signatory to a Schedule A agreement shall comply with subsection (a) in transferring and employing workers on Project Work.

Employment of District Residents. In recognition of the fact that the District and the communities surrounding Project Work will be impacted by the construction of the Project Work, the parties agree to support the hiring of workers from the residents of these surrounding areas, as well as veterans, regardless of their residence. Towards that end, the Unions shall first, exert their best efforts to encourage and provide referrals and utilization of qualified workers are: (i) Individuals currently residing in those first tier zip codes, as set forth in Attachment C attached hereto, including veterans, regardless of their residence. If the Unions cannot provide the Employers in the attainment of a sufficient number of Local Residents from within the first tier zip codes, the Unions shall second, exert their best efforts to then recruit and identify for referral Local Residents residing in second tier zip codes which reflect overlap the Gateway Citiesarea covered by the District as reflected on the U.S. Postal Service zip codes; and (ii) Regardless of where they reside, as set forth in Attachment C attached hereto. If (1) graduates of the Unions still have not provided the Employers in the attainment of a sufficient number of Local Residents, the Unions shall then third, exert their best efforts to recruit and identify for referral Local Residents residing within Los Angeles County. For dispatch purposesUnified School District, employees referred from any of the above three (2) Eligible Veterans, or (3) tiers shall be considered to be Local Residentsindividuals who have successfully completed the Building Trades Multi-Craft Core Curriculum Apprenticeship Readiness(“MC3”) Program. (b) A goal of forty percent (40%) of all of the construction workers employed on the Project shall be from workers described in (a) above with a goal that at least fifteen percent (15%) of all workers on each Project are from those first tier zip codes. To facilitate the dispatch of Local Residents, all Contractors will be required to utilize the Craft Employee Craft Request Form in effect at the time whenever they are requesting request the referral of any employee from a Union referral list for any Project WorkProject, a sample of which is attached as Attachment D. B. When Local Residents are requested by the Contractors, the Unions will shall refer such workers them regardless of their place in the Unions’ hiring halls’ list and normal referral procedures. (c) The Project Labor Coordinator shall work with the Unions and Contractors in the administration of this local residency goal. Employment of District Residents. (a) The In recognition of the District’s mission to serve the residents residing in and around the geographic area serviced by the District (“Local Residents”), the parties hereby establish a goal that 30% of all of the labor and craft positions (journeyman and apprentices) shall be from workers residing within a ten (10) mile radius of the District’s headquarters, as reflected on the list of U.S. Postal Service zip codes attached hereto as Exhibit “D.” In the attainment of this goal, the Unions and Contractors agree thatwill exert their best efforts, to the extent allowed by law, and as long as they possess the requisite skills and qualifications, the Unions will exert their best efforts to refer and/or recruit sufficient numbers of skilled craft Local Residents” as defined herein, Residents to fulfill the requirements of the Contractors. If the 30% local hire is still not attained utilizing these Residents, exert their best efforts the outreach shall expand to recruit other qualified employees which reside in the County of Los Angeles. The purpose of this section is to provide employment opportunities for those residents which live in communities in and identify for referral Local Residents residing within Los Angeles County. For dispatch purposesaround the geographic area serviced by the District, employees referred from any of the above three (3) tiers shall be considered to be Local Residentswhich have historically been economically depressed. (b) A goal of forty percent (40%) of all of the construction workers employed on the Project shall be from workers described in (a) above with a goal that at least fifteen percent (15%) of all workers on each Project are from those first tier zip codes. To facilitate the dispatch of Local Residents, all Contractors will be required to utilize the Employee Craft Request Form whenever they are requesting the referral of any employee from a Union referral list for any Project Work, a sample of which is attached as Attachment D.
