Common use of Endorsements Clause in Contracts

Endorsements. Each general liability and automobile liability insurance policy shall be with insurers possessing a AM Best’s rating of no less than A:VII and shall be endorsed with the following specific language: i. City, its elected or appointed officers, officials, employees, agents and volunteers are to be covered as additional insured’s under Consultant’s General Liability and Automobile Liability policies with respect to liability arising out of this Agreement and/or work performed by or on behalf of the Consultant, including materials, parts or equipment furnished in connection with such work or operations. ii. This policy shall be considered primary insurance as respects City, its elected or appointed officers, officials, employees, agents and volunteers. Any insurance maintained by City, including any self-insured retention City may have, shall be considered excess insurance only and shall not contribute with it. iii. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring Consultant. iv. The insurer waives all rights of subrogation against City except for Consultant’s Professional Liability and Employers’ Liability policies, its elected or appointed officers, officials, employees or agents. v. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to City, its elected or appointed officers, officials, employees, agents or volunteers. vi. No policies of insurance carried by Consultant shall be suspended, voided, canceled, or changed in coverage or in limits except after thirty (30) days written notice to the City Attorney by Certified Mail.

Any insurance maintained by Citythe City of Anaheim, including any self-insured retention the City of Anaheim may have, shall be considered excess insurance only and shall not contribute contributory with itthe insurance provided hereunder. (iii. ) This insurance shall act for each insured and each additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring Consultantcompany. (iv. ) The insurer waives all rights of subrogation against the City except for Consultant’s Professional Liability and Employers’ Liability policiesof Anaheim, its elected or appointed officers, board members, officials, employees or agentsemployees, agents and volunteers. v. (v) Any failure to comply with reporting provisions of the policies shall not affect coverage provided to Citythe City of Anaheim, its elected or appointed officers, officials, employees, agents or volunteers. Each general liability, automobile liability and automobile professional liability insurance policy shall be with insurers possessing issued by a AM Best’s rating financially responsible insurance company or companies admitted and authorized to do business in the State of no less than A:VII California, or which is approved in writing by CITY, and shall be endorsed with the following specific language:as follows. CONSULTANT also agrees to require all CONSULTANTs, and subconsultants to do likewise. i. City1. “The CITY, its elected or appointed officers, officials, employees, agents agents, and volunteers are to be covered as additional insured’s under Consultant’s General Liability and Automobile Liability policies insureds with respect to liability arising out of this Agreement and/or work performed by or on behalf of the ConsultantCONSULTANT, including materials, parts parts, or equipment furnished in connection with such work or operations.” ii2. This policy shall be considered primary insurance as respects CityCITY, its elected or appointed officers, officials, employees, agents agents, and volunteers. Any insurance maintained by CityCITY, including any self-insured retention City CITY may have, shall be considered excess insurance only and shall not contribute with itthis policy. iii3. Any insurance maintained by City, including any self-self- insured retention City may have, shall be considered excess insurance only and shall not contribute with it. iii. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring ConsultantLessee. iv. The insurer waives all rights of subrogation against City except for ConsultantLessee’s Professional Liability and Employers’ Liability policies, its elected or appointed officers, officials, employees or agents. v. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to City, its elected or appointed officers, officials, employees, agents or volunteers. vi. The CITY, its elected or appointed officers, officials, employees, agents and volunteers are to shall be covered as additional insured’s under Consultant’s General Liability and Automobile Liability on all such policies of insurance with respect to liability arising out of this Agreement and/or work services performed by or on behalf of the Consultant, including materials, parts or equipment furnished in connection with such work or operationsGimme Love. ii. The automobile liability insurance coverage shall be at least as broad as Insurance Services Office form number CA 0001 Code 1 (any auto).

Each general liability and automobile liability insurance policy shall be with insurers possessing a AM Best’s rating of no less than A:VII and shall be endorsed with the following specific language: i. City, its elected or appointed officers, officials, employees, agents and volunteers are to be covered as additional insured’s insured under ConsultantContractor’s General Liability and Automobile Liability policies with respect to liability arising out of this Agreement and/or work performed by or on behalf of the ConsultantContractor, including materials, parts or equipment furnished in connection with such work or operations. ii.
