Energy in Excess of Contract Capacity. SELLER shall not receive payment for any Energy and Green Attributes delivered in any hour to ANAHEIM in excess of the maximum hourly energy delivery quantity, as specified in Exhibit A.
Energy in Excess of Contract Capacity. The Seller shall not receive payment for any Energy or Green Attributes delivered in any hour to the Buyer in excess of the following amount of energy (in kilowatt-hours): 110% of the Contract Capacity (in kilowatts) multiplied by one hour. Any payment in excess of this amount shall be refunded to the Buyer, on demand.
