Enrollment discrimination is prohibited. a. The Contractor shall accept individuals eligible for enrollment in the order in which they apply without restriction (unless authorized by CMS), up to the limits set under this Agreement. b. The Contractor shall follow all Federal and State civil rights laws. The Contractor shall not unlawfully discriminate, exclude people, or treat them differently, on any ground protected under Federal or State law, including sex, race, color, religion, ancestry, national origin, ethnic group identification, age, mental disability, physical disability, medical condition, genetic information, marital status, gender, gender identity, or sexual orientation. e. The Contractor will not use any policy or practice that has the effect of discriminating on the basis of sex, race, color, religion, ancestry, national origin, ethnic group identification, age, mental disability, physical disability, medical condition, genetic information, marital status, gender, gender identity, or sexual orientation. f. The Contractor shall ensure the posting of a Department-approved nondiscrimination notice and language taglines in at least the top 16 non-English languages in the State, as determined by the Department, in a conspicuously visible font size, in conspicuous physical locations where the Contractor interacts with the public, in a conspicuous location on the Contractor’s website that is accessible on the Contractor’s home page, and in significant communications and significant publications targeted to beneficiaries, enrollees, applicants, and members of the public, as required by 45 CFR § 92.8. g. The Contractor shall provide information on how to file a Discrimination Grievance with: i. The Contractor and the Department if there is a concern of discrimination based on sex, race, color, religion, ancestry, national origin, ethnic group identification, age, mental disability, physical disability, medical condition, genetic information, marital status, gender, gender identity, or sexual orientation. ii. The United States Department of Health and Human Services Office of Civil Rights if there is a concern of discrimination based on race, color, national origin, sex, age, or disability.
