Environmental Emergencies. (3) A Sioux Valley Dakota Nation Law made under (1) will provide for environmental protections that are at least equal to any comparable protections under federal and provincial laws.

Environmental Emergencies. The Contractor/sub-contractor shall develop an Emergency Response Plan in accordance with Yorkshire Forward EMS requirements. The Contractor/sub- contractor shall inform Yorkshire Forward’s Representative of any pollution incidents or environmental emergency situations at the earliest opportunity during the Project. The Contractor/sub-contractor shall investigate and maintain records of any incidents and/or accidents.
Environmental Emergencies. 16.3 In the event of a Conflict between a Miawpukek Law made under 16.1 and Federal Law or Provincial Law, the Federal Law or Provincial Law will prevail to the extent of the Conflict.

For greater certainty, and except as set out in the Final Agreement, as the owner or the decision-maker in relation to the use of Tsawwassen Lands, Tsawwassen First Nation is responsible for the prevention of, preparedness for, timely response to and recovery from Environmental Emergencies that occur on Tsawwassen Lands.
