Tsawwassen First Nation will own all timber resources on Tsawwassen Lands, and will receive $100,000 from Canada and British Columbia to establish a Forest Resources Fund.
This regulation has been enacted for the purpose of regulating construction on Tsawwassen Lands in the general public interest.
The objective of this program is to increase employability and improve career opportunities for Tsawwassen Members, as well as other aboriginal peoples ordinarily resident on Tsawwassen Lands or in the surrounding area.
In some cases these harvesting rights apply on Tsawwassen Lands; in other cases these rights may be exercised in wider geographic areas described in the Final Agreement.
In particular, the pipeline crossing of the Fraser River near the Port Xxxx Bridge, the transit of ships through the Tsawwassen Fishing Area and Tsawwassen Intertidal Bivalve Harvest Area, and the brackish marshes in the Fraser River Delta adjacent to Tsawwassen Lands, are of great concern.
Tsawwassen hunters have previously described locations throughout their traditional territory as preferred harvesting areas for wildfowl, including all of what are now Tsawwassen Lands and nearby fields, the shoreline from west of the Xxxxxxx Bank causeway up to and including Brunswick Point, and areas in and around Westham Island.
The Land Act will be reviewed within 10 years after the Effective Date to determine if any amendments are required.15.3 Any change to land use and any acquisition of new land by Tsawwassen First Nation must include a community consultation process as set out in the community consultation legislation and the Land Act.15.4 Any proposal for the disposition of Tsawwassen Lands must be approved in accordance with the provisions of the Land Act.
The result is that, for TFN members, some of the best remaining waterfowl hunting opportunities along the foreshore of the Fraser Delta are located adjacent to Tsawwassen Lands – an area vastly smaller than what was once available to Tsawwassen harvesters.
Upon full build-out of all projects on Tsawwassen Lands contemplated in the Land Use Plan, an estimated $3.7 billion in total construction spending is anticipated to occur, supporting an estimated 18,960 person-years of direct construction employment.
There are also 62 hectares of additional lands (Other Tsawwassen Lands) that remain under the jurisdiction of the Corporation of Delta.
