Common use of Epidemic Failures Clause in Contracts

Epidemic Failures. In the event of an Epidemic Failure, Seller shall at its expense repair the defective Products, replace the defective Products or reimburse Buyer for the actual costs it incurs correcting the defect; provided, however, Buyer agrees to use reasonable efforts to mitigate such costs it incurs. Any Products returned to Seller shall be returned freight collect.
