Equipment Procurement and Construction Commencement. The Connecting Transmission Owner shall procure necessary equipment and commence construction of the Transmission Project and Network Upgrade Facilities as soon as practicable after the following additional conditions are satisfied: Approval of the appropriate Governmental Authority has been obtained for any facilities requiring regulatory approval; Necessary real property rights and rights-of-way have been obtained, to the extent required for the construction of a discrete aspect of the Transmission Project and Network Upgrade Facilities; The Connecting Transmission Owner has received written authorization to proceed with procurement and construction from the Transmission Developer by the date specified in Appendix B hereto; and The Transmission Developer has provided Security to the Connecting Transmission Owner in accordance with Article 11.5 by the dates specified in Appendix B hereto.
