Evidence Restrictions. Evidence not previously recorded in the employee's personnel file prior to the notification of the demotion, discipline or other involuntary change in the employment status shall not be used by the Board as a basis for its action.

Evidence not previously recorded in the employee's personnel file prior to the notification of discipline shall not be used by the Board as a basis for its statement of reasons except when these reasons relate to irremediable behavior on the part of the employee. Actions by the employee after notification may be used as evidence.
