Exceptional Education. Special education services, related services, and accommodations for students who are eligible under the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act of 1973 (Section 504), the Americans with Disabilities Act (ADA), or any applicable provisions of state law, shall be provided in accordance with applicable state and federal law, this Agreement and the Chartering Authority’s policy. The Chartering Authority is the local education agency (LEA) for purposes of compliance with the Individuals with Disabilities Education Act (IDEA). The Chartering Authority, pursuant to state law, addresses the needs of services for students with disabilities and gifted services in its Exceptional Education division.
Exceptional Education. 1. As the students served by University Schools would otherwise be served by Board, Board retains legal responsibility as the local educational agency for special education services for students who are eligible under the Individuals with Disabilities Education Act Section 504 of the Rehabilitation Act of 1973 (Section 504) and Tenn. Code ▇▇▇. § ▇▇-▇▇-▇▇▇ et seq. The Board is responsible for ensuring that the aforementioned federal and state special education laws and regulations are met in University Schools, and that special education and related services are provided in the University Schools in the same manner as they are provided in the Board’s schools. Additionally, the Board will oversee procedural compliance with the aforementioned federal and state laws and regulations concerning accommodations of and education of students with disabilities. 2. All exceptional education services at University Schools will be delivered by individuals or agencies qualified to provide exceptional education services. The Board shall be responsible for hiring, training, and employment of site staff necessary to provide exceptional education services to students, including without limitation, gifted education teachers, resource teachers, special education, speech therapists, nurses, occupational and physical therapists and one-on-one educational assistants or assigned educational assistants. Staffing of the instructional resource positions will be based on the total IEP service hours of the students served, in the same manner as with other Board schools. In regard to Board staffing placed at University Schools, University shall have all rights of selection, rejection or removal that LEA principals exercise over staff assigned to their schools. 3. All federal funding received by the Board for the provision of services in this Section (J) shall be retained by the Board in exchange for the provision of the exceptional educational services referenced in this Section. If those services are not able to be provided, those funds will be passed through to the University to hire appropriate staff.

  • Distance Education 7.13.1 Expanding student access, not increasing productivity or enrollment, shall be the primary determining factor when a decision is made to schedule a distance education course. There will be no reduction in force of faculty (as defined in Article XXIII of this Agreement) as a result of the District’s participation in distance education. 7.13.2 Courses considered to be offered as distance education shall be defined in accordance with the Board of Governors’ Title 5 Regulations and Guidelines. Generally, this definition refers to courses where the instructor and student are separated by distance and interact through the assistance of communication technology (reference section 55370 of Title 5 California Code of Regulations). The determination of which courses in the curriculum may be offered in a distance education format, in addition to instructor/student contact requirements, shall be in accordance with the Title 5 California Code of Regulations.
