Exceptions from Disclosure Tracking. Business Associate need not record disclosure information or otherwise account for disclosures of PHI that this Addendum or Recipient or the relevant Subsidiary in writing permits or requires (i) for the purpose of Recipient’s or its Subsidiaries’ treatment activities, payment activities, or health care operations, (ii) to the individual who is the subject of the PHI disclosed or to that individual’s personal representative; (iii) to persons involved in that individual’s health care or payment for health care; (iv) for notification for disaster relief purposes, (v) for national security or intelligence purposes, (vi) to law enforcement officials or correctional institutions regarding inmates; or (vii) pursuant to an authorization; (viii) for disclosures of certain PHI made as part of a Limited Data Set; (ix) for certain incidental disclosures that may occur where reasonable safeguards have been implemented; and (x) for disclosures prior to April 14, 2003.
Exceptions from Disclosure Tracking. Business Associate need not record disclosure information or otherwise account for disclosures of PHI or electronic PHI that this Agreement or Company in writing permits or requires (i) for purposes of Treating the individual who is the subject of the PHI or electronic PHI disclosed, payment for that Treatment, or for the Health Care Operations of Company or Business Associate (except where such recording or accounting is required by the HITECH Act, and as of the effective dates for this provision of the HITECH Act); (ii) to the individual who is the subject of the PHI or electronic PHI disclosed or to that individual’s personal representative; (iii) pursuant to a valid authorization by the person who is the subject of the PHI or electronic PHI disclosed; (iv) to persons involved in that individual’s health care or Payment related to that individual’s health care; (v) for notification for disaster relief purposes; (vi) for national security or intelligence purposes; (vii) as part of a Limited Data Set; or (viii) to law enforcement officials or correctional institutions regarding inmates or other persons in lawful custody.
Exceptions from Disclosure Tracking. Business Associate need not record disclosure information or otherwise account for disclosures of PHI that meet each of the following conditions:
(i) the disclosures are permitted under this Agreement, or are expressly authorized by the Covered Entity in another writing; and,
(ii) the disclosure is for one of the following purposes:
1. the Covered Entity’s Treatment, Payment, or Health Care Operations;
2. in response to a request from the Individual who is the subject of the disclosed PHI, or to that Individual’s Personal Representative;
3. made to persons involved in that individual’s health care or payment for health care;
4. for notification for disaster relief purposes;
5. for national security or intelligence purposes; or,
6. to law enforcement officials or correctional institutions regarding inmates.

Business Associate need not report Disclosure of information or otherwise account for Disclosures of PHI that this Agreement or Company in writing permits or requires (i) for the purpose of Company’s Treatment activities, Payment activities, or Health Care Operations (except where such recording or accounting is required by the HITECH Act), and as of the effective dates for any such requirements; (ii) to the Individual who is the subject of the PHI disclosed, to that Individual’s Personal Representative or to another person or entity authorized by the Individual; (iii) to persons involved in that Individual’s Health Care or Payment for Health Care; (iv) for notification for disaster relief purposes; (v) for national security or intelligence purposes; (vi) to Law Enforcement Officials or Correctional Institutions regarding Inmates; or (vii) disclosed in a limited data set. Business Associate need not report any Disclosure of PHI that was made before April 14, 2003.

Business Associate (and any subcontractor or agent) need not record disclosure information or otherwise account for disclosures of PHI that this Addendum or Group Health Plan in writing permits or requires (i) for the purpose of treatment activities, payment activities, or health care operations; (ii) to the individual who is the subject of the PHI disclosed or to that individual’s personal representative; (iii) to persons involved in that individual’s health care or payment for health care; (iv) for notification for disaster relief purposes, (v) for national security or intelligence purposes; or (vi) to law enforcement officials or correctional institutions regarding inmates.
Exceptions from Disclosure Tracking. Business Associate need not record disclosure information or otherwise account for disclosures of Protected Health Information that this Agreement or Covered Entity in writing permits or requires:
(i) for purposes of treating the individual who is the subject of the Protected Health Information disclosed, payment for that treatment, or for the health care operations of Covered Entity; (ii) to the individual who is the subject of the Protected Health Information disclosed or to that individual’s personal representative; (iii) pursuant to a valid authorization by the person who is the subject of the Protected Health Information disclosed; (iv) to persons involved in that individual’s health care or payment related to that individual’s health care;
(v) for notification for disaster relief purposes; (vi) for national security or intelligence purposes; (vii) as part of a limited data set; or (viii) to law enforcement officials or correctional institutions regarding inmates or other persons in lawful custody.

Business Associate need not report Disclosure of information or otherwise account for Disclosures of PHI that this Agreement or Company in writing permits or requires (i) for the purpose of Company’s Treatment activities, Payment activities, or Health Care Operations (except where such recording or accounting is required by the HITECH Act), and as of the effective dates for any such requirements, (ii) to the Individual who is the subject of the PHI disclosed, to that Individual’s Personal Representative or to another person or entity authorized by the Individual (iii) to persons involved in that Individual’s Health Care or Payment for Health Care; (iv) for notification for disaster relief purposes, (v) for national security or intelligence purposes, (vi) to Law Enforcement Officials or Correctional Institutions regarding Inmates; or (vii) disclosed in a limited data set.
Exceptions from Disclosure Tracking. Business Associate will not be required to record Disclosure Information or otherwise account for disclosures of Individuals’ Protected Health Information (a) for Treatment, Payment or Health Care Operations, (except where required by the HITECH Act, as of the effective dates of such requirements) (b) to the Individual who is the subject of the Protected Health Information, to that Individual’s personal representative, or to another person or entity authorized by the Individual (c) to persons involved in that Individual’s health care or payment for health care as provided by 45 Code of Federal Regulations § 164.510, (d) for notification for disaster relief purposes as provided by 45 Code of Federal Regulations § 164.510, (e) for national security or intelligence purposes, (f) to law enforcement officials or correctional institutions regarding inmates, (g) that are incident to a use or disclosure that is permitted by this Agreement or the ASO Agreement, (h) as part of a limited data set in accordance with 45 Code of Federal Regulations § 164.514(e), or (i) that occurred prior to the Plan’s compliance date.
Exceptions from Disclosure Tracking. FAI will not be required to record Disclosure Information or otherwise account for disclosures of Members’ Protected Health Information that the Administrative Services Agreement(s), this Business Associate Agreement or Plan in writing permits or requires:
(a) for Treatment activities, Payment activities or Health Care Operations,
(b) to the Covered Person who is the subject of the Protected Health Information or to that Covered Person’s personal representative,
(c) incident to a use or disclosure otherwise permitted by the Privacy Rules,
(d) pursuant to an authorization,
(e) to persons involved in that Covered Person’s health care or payment for health care as provided by 45 Code of Federal Regulations § 164.510,
(f) for notification for disaster relief purposes as provided by 45 Code of Federal Regulations § 164.510,
(g) as part of a limited data set, as permitted by 45 Code of Federal Regulations § 164.514(e),
(h) for national security or intelligence purposes, or
(i) to law enforcement officials or correctional institutions regarding inmates.

Business Associate need not record disclosure information or otherwise account for disclosures of PHI that this Addendum or the Covered Entity in writing permits or requires (i) for the purpose of Covered Entity’s treatment activities, payment activities, or health care operations, (ii) to the individual who is the subject of the PHI disclosed or to that individual’s personal representative, (iii) to the persons involved in that individual’s health care or payment for health care, (iv) for notification for disaster relief purposes, (v) for national security or intelligence purposes or (vi) to law enforcement officials or correctional institutions regarding inmates, or (vii) when the Business Associate has served a Subpoena or signed Authorization demanding release of the records as part of litigation on the Covered Entity.
