Common use of Exclusivity of Rights Clause in Contracts

Exclusivity of Rights. 3.2.1 Subject to the provisions of this Agreement, the Operating Rights are granted exclusively to the Terminal Operator from the Signature Date until the termination or expiry of this Agreement in accordance with its terms. 3.2.2 The Terminal Operator shall also be entitled to use the Port Infrastructure for the purposes of the Project in accordance with the Port Rules, subject to the use thereof by any other Port Users in accordance with the Port Rules.
