Common use of Excuse from performance of obligations Clause in Contracts

Excuse from performance of obligations. The Concessionaire shall not be considered in breach of its obligations under this Agreement if any part of the Project is not available to Users on account of any of the following for the duration thereof: (a) an event of Force Majeure; (b) measures taken to ensure the safe use of the Project except when unsafe conditions occurred because of failure of the Concessionaire to perform its obligations under this Agreement; or (c) compliance with a request from Maha-Metro or the directions of any Government Instrumentality, the effect of which is to close all or any part of the Project. Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the Project open to public provided they can be operated safely.

Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the Project open to public traffic/ Users provided they can be operated safely.

The Concessionaire shall not be considered in breach of its obligations under this Agreement if any part of partof the Project is not available to Users on account of any of the following for the duration thereof:; (a) an event of Force force Majeure; (b) measures taken to ensure the safe use of the Project except when unsafe conditions occurred because occurredbecause of failure of the Concessionaire to perform its obligations under this Agreement; or (c) compliance with a request from Maha-Metro form the Procuring Entity or the directions of any Government InstrumentalityGovernmentInstrumentality, the effect of which is to close all or any part of the Project. ;’ d) Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the Project open to public opento Users provided they can be operated safely.

The Concessionaire shall not be considered in breach of its obligations under this Agreement if any part of the Project is not available to Users the Customers on account of any of the following for the duration thereof: (a) an event of Force Majeure; (b) measures taken to ensure the safe use of the Project except when unsafe conditions occurred because of failure of the Concessionaire to perform its obligations under this Agreement; or (c) compliance with a request from Maha-Metro the Authority or the directions of any Government Instrumentality, the effect of which is to close all or any part of the Project. The Concessionaire shall not be considered in breach of its obligations under this Agreement if any part of the Project is not available to Users traffic on account of any of the following for the duration thereof: (a) an event of Force Majeure; (b) measures taken to ensure the safe use of the Project except when unsafe conditions occurred because of failure of the Concessionaire to perform its obligations under this Agreement; or (c) compliance with a request from Maha-Metro the MOPIT or the directions of any Government Instrumentality, the effect of which is to close all or any part of the ProjectProject . Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the Project open to public traffic provided they can be operated safely.

Excuse from performance of obligations. The Concessionaire shall not be considered in breach of its obligations under this Agreement if any part of the Project Facility is not available to the Users on account of any of the following for the duration thereof: (a) an event of Force Majeure; (b) measures taken to ensure the safe use of the Project Facility or any part thereof except when unsafe conditions occurred because of failure of the Concessionaire to perform its obligations under this Agreement; or (c) compliance with a request from Maha-Metro the Authority or the directions of any Government Instrumentality, the effect of which is to close all or any part of the ProjectProject Facility. Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the Project open to public provided they can be operated safely.

The Concessionaire shall not be considered in breach of its obligations under this Agreement if any part of the Project is not available to Users users on account of any of the following for the duration thereof: (a) an event of Force Majeure; (b) measures taken to ensure the safe use of the Project not exceeding (●) Days, except when unsafe conditions occurred because of failure of the Concessionaire to perform its obligations under this Agreement; or (c) compliance with a request from Maha-Metro FBR or the directions of any Government Instrumentality, the effect of which is to close all or any part of the Project. Notwithstanding the above, the Concessionaire shall keep all unaffected parts of the Project open to public available for use provided they can be operated safely.
