Execution of Real Property Lease. Buyer shall have entered into a new triple net lease with the owner of the real property located at 000 Xxxxx Xxxxxx, Xxxxxxx, Xxxxxxxxxxxxx, on mutually agreeable terms, which lease shall provide for a five (5) year lease term, with base rent of One Hundred Seventy-nine Thousand Five Hundred Fifty and 00.100 Dollars ($179,550.00) in the first year of the lease and an increase of two and 00/100 percent (2.00%) per annum in each subsequent year (the “Lease”).

  • Real Property Leases Section 2.12 of the Disclosure Schedule lists all Leases and lists the term of such Lease, any extension and expansion options, and the rent payable thereunder. The Company has delivered to the Buyer complete and accurate copies of the Leases. With respect to each Lease:

  • Personal Property Leases Except as set forth in Schedule 3.13.(b), Company has no leases of personal property involving consideration or other expenditure in excess of $5,000 or involving performance over a period of more than three months.

To the knowledge of the Company and the Operating Partnership, water, storm water, sanitary sewer, electricity and telephone service are all available at the property lines of such property over duly dedicated streets or perpetual easements of record benefiting such property. Except as described in the Registration Statement and the Prospectus, to the knowledge of the Company and the Operating Partnership, there is no pending or threatened special assessment, tax reduction proceeding or other action that, individually or in the aggregate, could reasonably be expected to increase or decrease the real property taxes or assessments of any of such property, that, individually or in the aggregate, could reasonably be expected to have a Material Adverse Effect.
