Exercise of New Warrants. At the Closing, and in consideration of the reduction of the exercise price of the Current Warrants as herein provided, the Investors shall exercise all the New Warrants. The full purchase price therefor shall be paid to the Company at the Closing by wire transfer of immediately available funds to the Company's bank account in Dallas, Texas, or by delivery at the Closing of a cashier's check payable to the order of the Company.

Exercise of New Warrants. 6.1 Subject to the Terms and Conditions, the Holder of a New Warrant may exercise the New Warrant at any time on or after the Issuance Date of such New Warrant in whole or in part, at the option of the Holder, upon delivery of an executed Exercise Notice and payment of the Exercise Price, which may be made, at the option of the Holder, by cash delivered to the Warrant Agent at the principal office of the Warrant Agent in Denver, CO or to the office of one of its agents as may be designated in writing by the Warrant Agent, or by wire transfer of funds to the account of the Warrant Agent set forth on Schedule A to the Terms and Conditions attached as Exhibit A or Exhibit B, as the case may be.

  • Delivery of New Warrants Upon Exercise If this Warrant shall have been exercised in part, the Company shall, at the request of a Holder and upon surrender of this Warrant certificate, at the time of delivery of the Warrant Shares, deliver to the Holder a new Warrant evidencing the rights of the Holder to purchase the unpurchased Warrant Shares called for by this Warrant, which new Warrant shall in all other respects be identical with this Warrant.
