Common use of Exercise of Seniority by Laid-Off Teachers Clause in Contracts

Exercise of Seniority by Laid-Off Teachers. a. Subject to possessing the necessary qualifications, continuing teachers who are laid-off during a school year shall be eligible to exercise their seniority starting with the most junior teacher in the District, as follows: i. in semester schools, at the commencement of a new semester and immediately following spring break, or ii. in schools operating a quarter system, at the beginning of any quarter, or iii. in other schools, on September 1st, January 1st and immediately following spring break. b. The onus of proof of qualifications for other positions falls on the teacher who is to be laid-off. Such proof must be produced and submitted to the Superintendent or designate within ten (10) school days of receipt of lay-off notice.
