Common use of Facility Manager Clause in Contracts

Facility Manager. The Owners/Promoters may hand over management and upkeep of all Common Areas to a professional facility management organization (Facility Manager). In this regard, it is clarified that (1) the Facility Manager shall operate, manage and render specified day to day services with regard to the common areas of the Said Complex (2) the Facility Manager shall levy and collect the common expenses/maintenance charges (3)the Allottees shall be bound to pay the common expenses/maintenance charges to the Facility Manager (4) the Facility Manager, being a professional commercial organization, will not be required to render any accounts to the Allottees and it shall be deemed that the Facility Manager is rendering the services to the Allottees for commercial considerations (5) the Facility Manager shall merely be the service provider for rendition of services with regard to the common portions and no superior rights with regard to the common portions shall vest in the Facility Manager.

In this regard, it is clarified that (1) the Facility Manager shall operate, manage and render specified day to day-to-day services with regard to the common areas of the Said Complex Common Portions (2) the Facility Manager shall levy and collect the common expenses/maintenance charges Maintenance Charges (3)the Allottees Allottee shall be bound to pay the common expenses/maintenance charges Maintenance Charges to the Facility Manager (4) the Facility Manager, being a professional commercial organization, will not be required to render any accounts to the Allottees Allottee and it shall be deemed that the Facility Manager is rendering the services to the Allottees Allottee for commercial considerations and (5) the Facility Manager shall merely be the service provider for rendition of services with regard to the common portions Common Portions and no superior rights with regard to the common portions Common Portions shall vest in the Facility Manager.
